Rental Agreement and Waiver

Rental agreement takes effect on requested/booked dates of rental.

All rental gear will remain the property of Lemon Bay Littles Baby and Beach Rentals. If renter fails to surrender items on agreed return date and time, Lemon Bay Littles Baby and Beach Rentals LLC reserves the right to charge the renter's credit card for full retail value of rental items in addition to charges that took place during the rental period.

Renter agrees to pay a Delivery/Pick Up/ Cleaning fee of $50.00, that will be added to the reservation once it is completed.

Renter is expected to inspect the rental gear, upon delivery, and find them to be in acceptable and good condition and if inspection is otherwise true will report it to Lemon Bay Littles Baby and Beach Rentals immediately. Renter will return the items in the same condition they were received. If items are returned damaged or in disrepair, including missing parts, the renter is obligated to pay the cost of repair or replacement, at current retail costs.

The renter is responsible for reading and following manufacturer’s instructions that may accompany rental items. Manufacturers' manuals can be found online or requested at the time of delivery.

The renter is liable for use of equipment and in the event of an accident, including death, releases Lemon Bay Littles Baby and Beach Rentals LLC from any and all claims arising. Under no circumstances will Lemon Bay Littles LLC be held responsible for any damage, injury or loss, including death, arising from the use of any rented equipment or the failure of the equipment to function as intended by the manufacturer.

Cancellations:
More than 7 days prior to delivery: full refund (minus processing fees, if charged)
3-7 days before delivery: 50% refund
less than 72 hours before delivery: No refund

**there are NO REFUNDS for early returns**

It is the sole responsibility of the renter to install rented car seats into their own cars. A manufacturer manual can be provided, upon request. The renter is responsible for notifying Lemon Bay Littles Baby and Beach Rentals LLC within 24 hours of any vehicle accident, with the rented car seat. After the accident is reported, the renter is responsible for immediately paying the costs to replace the car seats- directly to Lemon Bay Littles LLC, rather than waiting on their insurance to reimburse them first. A claim will need to be filed at a later time to receive an insurance reimbursement for the costs of the replacement car seats. Lemon Bay Littles Baby and Beach Rentals LLC will not be delayed in payment, due to insurance claims.

Liability Waiver

Renter will use equipment only for and in accordance with its intended use. Loss or damage to the equipment is the responsibility of the renter. Reasonable wear and tear are expected. In no event will Lemon Bay Littles Baby and Beach Rentals LLC be held responsible for any damage, loss or injury (including death) caused by or arising out of the use of any equipment provided by Lemon Bay Littles Baby and Beach Rentals LLC or the failure of the equipment to function as intended. Full right and ownership of the equipment will always be owned by Lemon Bay Littles Baby and Beach Rentals LLC. It is the renter’s responsibility to inspect the equipment prior to use to determine fitness and state of repair and to return the equipment in the same state of repair and cleanliness when delivered.

RENTER FURTHER AGREES TO INDEMNIFY AND HOLD HARMLESS THE LESSOR FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES (INCLUDING NEGLIGENCE, TORT AND STRICT LIABILITIES), DEMANDS, ACTIONS, SUITS AND PROCEEDINGS, LOSSES, COSTS, PENALTIES AND DAMAGES, INCLUDING WITHOUT LIMITATIONS, REASONABLE ATTORNEYS’ FEES AND COST(COLLECTIVELY “CLAIMS”), ARISING OUT OF, CONNECTED WITH, OR RESULTING FROM THE MANUFACTURE, SELECTION, PURCHASE, DELIVERY, POSSESSION, CONDITION, USE, OPERATION, HANDLING, TRANSPORTATION OR RETURN OF THE LEASED PROPERTY.

THIS AGREEMENT SHALL BE INTERPRETED AND GOVERNED IN ACCORDANCE TO FLORIDA LAW.

I understand by checking the "Rental Agreement and Waiver box” at checkout and placing my order through Lemon Bay Littles Baby and Beach Rentals that I have agreed to the release of liability and the terms and condition stated in this document. I take full responsibility for the safety and well-being of my child(ren) while they are using the rented equipment provided. I take full responsibility of proper and correct use of rented equipment.
